In the first case the judges had let other slave free but not him. He wanted to be free but he couldnt. For him to be free he needed the decision from the court. But he begin to be slave.

Dred Scott never fought in the Civil War and he was not a member of the 54th! His owner took him to two states where slavery as prohibited, so Mr. Scott argued that he should have been set free (which the racist Supreme Court as you pointed out disagreed)!
